PREAMBLE

1. These general terms and conditions of sale are agreed between Gotu Lda, with registered office at Rua da Igreja, n200, 4750-847 Vila Frescainha (S. Pedro), tax identification number 515 655 570 and contact number +351 253 193 514, hereinafter referred to as “GOTU”, and persons wishing to make purchases through the website www.gotu.pt, hereinafter referred to as “User”.

2. The parties agree that purchases made through the website www.gotu.pt will be governed exclusively by this contract, excluding any conditions previously available on the website.

ITEM 1 – OBJECT

1. These general terms and conditions of sale aim to provide and define all the information necessary for the User regarding the methods of ordering, sale, payment and provision of service or delivery of purchases made on the website www.gotu.pt

2. These terms and conditions govern all the steps necessary to place an order and guarantee the tracking of this order/service provision between the Contracting Parties.

ARTICLE 2 – REQUEST

The User places their order by completing the purchase process presented on the website www.gotu.pt, adding the product(s) or service(s) they wish to order to their shopping cart:

To submit your order, the User must:

a) Provide the requested information at checkout so that we can guarantee the best possible service.

b) Alternatively, log in (providing an email and password combination chosen by the User during registration) to take advantage of the Points and Wishlist system.

c) Complete the information and choose the options available to you throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the Tax Identification Number and name that you want to appear on the invoice for tax purposes).

- The User's final confirmation of the order is equivalent to full and complete acceptance of the prices and descriptions of the products/services available for sale, as well as these General Terms and Conditions of Sale, which will be the only ones applicable to the contract thus concluded.

GOTU will honor online orders up to the limit of available stock. If a product/service is unavailable, GOTU undertakes to inform the User as soon as possible.

- The data contained in the invoice is the sole responsibility of the User. Once issued, the invoice cannot be reissued with changes. If you wish to change the invoice data before it is issued, please contact us via email at ola@gotu.pt

- Order requests are valid for 3 (THREE) days, unless the order is registered under a promotional campaign that defines a different deadline. We cannot guarantee the provision of the service, prices, discounts, promotions, and offers beyond this period. If payment is not received by our services within the aforementioned period, the order cannot be validated. Any amount received after this date will be refunded or used for a new order.

ARTICLE 3 – PAYMENT

- On the website www.gotu.pt, GOTU offers the User the following payment methods:

  • Credit card (Visa, Mastercard) (Service provided by CGD);
  • PayPal
  • Bank Transfer
  • MBWay (Service provided by CGD );
  • Multibanco Entity and Reference (Service provided by CGD );
  • Payments in installments via credit card ( Service provided by Sequra or Cofidis Pay)

- In the case of payment by credit card, the debit will be made to the User's card immediately after order confirmation. In case of order cancellation for any reason, the amount will be refunded by the same method or another mutually agreed upon method.

- By choosing Bank Transfer, you agree to make the payment as soon as you send us the corresponding proof of payment. In case of cancellation by the customer after the goods have been shipped, a new invoice will be issued with a Late Payment and Administrative Fee of R$50. In case of prolonged default, the legal entities as well as the customer's bank will be notified of this default.

ARTICLE 4 – DELIVERY/AVAILABILITY AND CONSUMPTION

- Orders are shipped within 2 to 5 business days after order confirmation, when items are in stock at the physical store or warehouse. Delivery is usually handled by MRW. Other shipping methods may be used if necessary. In case of stock shortage, we will contact you as soon as possible.

- National shipping costs will be added to the order, amounting to €4.50 or €10 (depending on the volume of the goods) for orders under €100 shipped within mainland Portugal. For orders exceeding €100 to be delivered within mainland Portugal, shipping costs will be waived.

- For orders to be shipped to the Islands (Azores and Madeira), shipping costs are different. The customer can calculate the shipping cost during the checkout process. All shipping costs can be viewed before the order is finalized and paid for.

The service and/or merchandise will be made available after confirmation of payment.

- Some items can be rented, such as babywearing items or car seats. These cost €2 (for babywearing) or €5 (for a car seat) per day. The total sale price of the item is considered a deposit. The cost is charged from the day of shipment until the day of collection. Both shipment and collection are our responsibility. After checking the integrity of the items, we will return the deposit, subtracting the total rental cost (€2 or €5 x (number of days)). Subject to availability of stock reserved for rent.


ARTICLE 5 – PRICES

- Prices are in Euros, including taxes and duties, taking into account the VAT in effect on the date of payment of the order.

Unless otherwise indicated, discount codes or coupons cannot be combined with promotional prices and/or temporary offers in effect on the website.


ARTICLE 6 – CANCELLATION, EXCHANGE OR RETURN

- The cancellation, exchange, or return process is handled on a case-by-case basis by GOTU. The request must be submitted in writing to the contact email address ola@gotu.pt, and provided that the products are not food items, handmade products, or that the right of return does not apply for health or hygiene reasons, the 14-day return period applies from the date of receipt of the order. / from the date the contract is signed (in the case of service contracts).

- You must return the goods or deliver them to us at "Gotu - Travessa do Teixeirinha, n33, 4750-336 Barcelos", without undue delay and no later than 14 days from the day on which you inform us of your decision to withdraw from the contract. The deadline is considered met if you return the goods before the end of the 14-day period.

- The CUSTOMER is responsible for the direct costs of returning the goods , either by their own means or through the collection service offered by GOTU, which costs €4.50. For bulky items, such as car seats, this amount increases to €10.


GOTU undertakes to reimburse the User for the value of the returned item(s) within a maximum of 5 business days after confirmation of the cancellation on our part, in writing. The amount paid for shipping costs will not be reimbursed, as these are related to the transport service contracted by us. The service is considered completed upon receipt of the order.

- In the case of returning one or more items, without making up the total number of items ordered, and causing the total amount paid for the order to fall below the free shipping offer limit (€100), the shipping cost will be deducted from the amount to be refunded to the customer.

Returning any item or part of an order voids any right to benefit from promotional campaigns or conditions that depend on the purchase of the items to be returned (Buy X Get Y Free, discount on the 2nd item, among other examples). The amount to be refunded reflects the elimination of the campaign conditions.


- Returned products must be in saleable condition, meaning in the same condition as when they arrived in the User's hands, without any defects or damage (including any packaging, box, filling material, or wrapping).

- Car seats are not subject to return, except in rare cases, determined after a case-by-case analysis by GOTU.

- Babywearing is considered a non-returnable item, except for manufacturing defects, as it comes into contact with the baby's fluids (nasal, oral, etc.) when tried on. Returns of such items, when approved by GOTU, are subject to the babywearing rental conditions (SEE ARTICLE 4).

We may withhold reimbursement until we have received the returned goods and verified their condition and integrity.

ARTICLE 7 - LAW AND JURISDICTION

  • The conditions described above are governed by Portuguese law. The resolution of any dispute will be subject to Portuguese law and courts, with express waiver of any other jurisdiction.

In the event of a consumer dispute, the consumer may resort to the following alternative dispute resolution entity:
