PREAMBLE
1. These general terms and conditions of sale are agreed between Gotu Lda, with registered office at Rua da Igreja, n200, 4750-847 Vila Frescainha (S. Pedro), tax identification number 515 655 570 and contact +351 253 193 514, hereinafter referred to as “GOTU“ and persons wishing to make purchases through the website www.gotu.pt hereinafter referred to as “User”.
2. The parties agree that purchases made through the website www.gotu.pt will be regulated exclusively by this contract, excluding any conditions previously available on the website.
ARTICLE 1 – PURPOSE
1. The purpose of these general terms and conditions of sale is to provide and define all the information necessary for the User regarding the methods of ordering, selling, paying for and providing services or delivering purchases made on the website www.gotu.pt.
2. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order/service provision between the Contracting Parties.
ARTICLE 2 – ORDER
- The User completes his/her order by completing the purchase process presented on the website www.gotu.pt, adding the product(s) or service(s) he/she wishes to order to the shopping basket:
- To send your order, the User must:
a) Provide the information requested at check-out so that we can guarantee the best possible service.
b) Alternatively, log in (providing a combination of email and password chosen by the User when registering) to use the Points and Wishlist system.
c) Complete the information and choose the options available to you throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the NIF and name that, for tax purposes, you wish to appear on the invoice).
- The final confirmation of the order by the User is equivalent to full and complete acceptance of the prices and description of the products/services available for sale as well as these General Conditions of Sale, which will be the only ones applicable to the contract thus concluded.
- GOTU will honor orders received online up to the limit of available stocks. In the event of unavailability of the product/service, GOTU undertakes to inform the User as soon as possible.
- The data contained in the invoice are the sole responsibility of the User. Once the invoice has been issued, it cannot be reissued with changes. If you wish to change the data on the invoice before it is issued, please contact us via email at ola@gotu.pt
- Orders are valid for 3 (THREE) days, unless the order is registered under a promotional campaign that defines a different period, and it is not possible to guarantee the provision of the service, prices, discounts, promotions and offers beyond this period. If payment is not received by our services within the aforementioned period, the order cannot be validated. Any amount received after this date will be returned or used in a new order.
ARTICLE 3 – PAYMENT
- On the website www.gotu.pt, GOTU offers the User the following payment methods:
- Credit card (Visa, Mastercard) (Service provided by CGD);
- PayPal
- Bank Transfer
- MBWay (Service provided by CGD );
- Multibanco Entity and Reference (Service under the responsibility of CGD );
- Split Payments by Credit Card ( Service provided by Klarna)
- In the case of payment by credit card, the debit will be made to the User's card immediately after confirmation of the order. In the event of cancellation of the order for any reason, the amount will be refunded by the same means or another mutually agreed method.
- By choosing Bank Transfer, you are agreeing to comply with the payment, as soon as you send us the respective proof. In case of cancellation by the customer after the goods have been sent, a new invoice will be issued with a Late Payment and Administrative Fee of €50. In case of prolonged non-compliance, the legal entities as well as the customer's bank will be notified of this non-compliance.
ARTICLE 4 – DELIVERY/AVAILABILITY AND CONSUMPTION
- Orders will be shipped within 2 to 5 business days after order confirmation, when items are in stock at the physical store or warehouse. Delivery is carried out by MRW in most cases. Other shipping methods may be used if necessary. In the event of a stock shortage, we will contact you as soon as possible.
- National shipping costs will be added to the order, which will be €4.5 or €10 (depending on the volume of the goods) for orders under €100 to be sent to mainland Portugal. For orders to be delivered to mainland Portugal over €100, no shipping costs will be charged.
- For orders to be sent to the Islands (Azores and Madeira), shipping costs are different. The customer can calculate the shipping cost during the checkout process. All shipping costs can be consulted before placing and paying for the order.
- The service and/or merchandise will be made available after confirmation of payment made.
- Some items can be rented, such as babywearing items or car seats. These have a daily cost of €2 (in the case of babywearing items) or €5 (in the case of a car seat). The total sale price of the item is considered a deposit. The cost is charged from the day of dispatch to the day of collection. Both the dispatch and collection are our responsibility. After checking the integrity of the items, we will return the deposit, minus the total rental price ((€2 or €5) x (number of days)). Subject to availability of stock reserved for someone.
ARTICLE 5 – PRICES
- Prices are to be understood in Euros, with taxes and fees included, taking into account the VAT in force on the date of payment of the order.
- Unless otherwise stated, discount codes or discount coupons cannot be combined with promotional prices through temporary campaigns in force on the website.
ARTICLE 6 – CANCELLATION, EXCHANGE OR RETURN
- The cancellation, exchange or return process is handled on a case-by-case basis by GOTU. The request must be sent in writing to the contact email ola@gotu.pt, and provided that they are not food products, handmade products or that the right to return does not apply for health or hygiene reasons, the 14-day return period applies from the date of receipt of the order. / the day of the conclusion of the contract (in the case of service provision contracts).
- You must return the goods or deliver them to us at "Gotu - Travessa do Teixeirinha, n33, 4750-336 Barcelos", without undue delay and no later than 14 days from the day on which you inform us of your free termination of the contract. The deadline will be considered to be respected if you return the goods before the end of the 14-day period.
- The CUSTOMER must bear the direct costs of returning the goods , either by their own means or by the collection service offered by GOTU, at a cost of €4.50. For bulky items, such as car seats, this amount increases to €10.
- GOTU undertakes to reimburse the User for the value of the returned item(s) within a maximum period of 5 working days after confirmation of the cancellation by us, in writing. The amount paid for shipping costs will not be refunded, as these refer to the transport service contracted by us. The service is considered completed upon receipt of the order.
- In the event of returning one or more items, without making up the total number of items ordered, and reducing the total amount paid for the order below the free shipping offer limit (€100), the shipping costs will be deducted from the amount to be returned to the customer.
- The return of any item or part of the order eliminates any right to benefit from campaigns or promotional conditions that depend on the purchase of such items to be returned (Pay X, get Y, discount on the 2nd item, among other examples). The amount to be returned reflects the elimination of the campaign conditions.
- Returned products must be in a saleable condition, that is, in the same condition in which they arrived in the User's hands, without any anomaly or damage (including any packaging, box or filling or wrapping material).
- Car seats are not subject to return, except in rare exceptions, determined after analysis on a case-by-case basis by GOTU.
- Babywearing is considered a non-exchangeable item, except for manufacturing defects, as when trying it on it is subject to contact with the baby's fluids (nasal, oral, etc.). The return of such an item, when approved by GOTU, is subject to the babywearing rental conditions (SEE ARTICLE 4)
- We may withhold reimbursement until we have received the returned goods and checked their condition and completeness.
ARTICLE 7 - LAW AND JURISDICTION
- The conditions described above are governed by Portuguese Law. The resolution of any dispute will be the responsibility of Portuguese law and courts, with express waiver of any others.
